PAIA Manual

This manual is published in terms of Section 51 of the Promotion of Access to Information Act, 2000 (Act No. 2 of 2000) (“PAIA”) and is intended to assist any person seeking to exercise their right of access to information held by Brand Guard (Pty) Ltd (“Brand Guard”).

2. Guide on How to Use PAIA
The Information Regulator has compiled a guide, in terms of Section 10 of PAIA, containing information required by a person wishing to exercise any right contemplated by PAIA and POPIA. The guide is available from the Information Regulator at inforegulator.org.za.
3. Records Available in Terms of Other Legislation
Records may be available, on request, in terms of legislation including:

- Income Tax Act 58 of 1962
- Value Added Tax Act 89 of 1991
- Labour Relations Act 66 of 1995
- Basic Conditions of Employment Act 75 of 1997
- Employment Equity Act 55 of 1998
- Compensation for Occupational Injuries and Diseases Act 130 of 1993
- Occupational Health and Safety Act 85 of 1993
- National Environmental Management: Waste Act 59 of 2008

4. Records Held by Brand Guard
The following categories of records are held and may be requested:
- Company registration and statutory records
- Financial records, tax records and audited financial statements
- Client and supplier contracts, quotations and Certificates of Destruction
- Operational records relating to destruction services and chain-of-custody
- Human resources records, payroll and employment contracts
- Health, safety and environmental compliance records
- Internal policies, procedures and correspondence
5. Procedure for Requesting Access
- Complete the prescribed PAIA Form 02 (available from the Information Regulator).
- Submit the form and proof of identity to the Information Officer at the address above.
- Pay the prescribed request and access fees, where applicable.
- A response will be provided within 30 days of receipt of a valid request.
6. Grounds for Refusal
Access to records may be refused on the grounds set out in Chapter 4 of Part 3 of PAIA, including the protection of third-party privacy, commercial information, confidential information, safety of individuals and property, and records protected by legal privilege.
7. Fees
Fees payable in respect of requests are those prescribed in the regulations to PAIA, as published from time to time by the Minister of Justice and Correctional Services.
8. Updates
This manual will be updated from time to time as required. The latest version is available on this page or on request from the Information Officer.
